Thank you for contacting me with regard to H.R. 4439, the Tobacco Tax Parity Act. I appreciate hearing from you on this matter.
Tobacco products are subject to excise taxes, which are taxes levied on the production, importation, or sale of particular products. In many cases, excise taxes are used to fund particular national priorities or programs. For example, proceeds from the excise taxes assessed on tobacco and tobacco-related products are used to finance the State Children's Health Insurance Program (SCHIP), which provides access to quality health care to millions of uninsured children.
As you may be aware, tax rates for roll-your-own cigarette tobacco and pipe tobacco are substantially different. Currently, roll-your-own cigarette tobacco is taxed at a rate of $24.79 per pound, while pipe tobacco is taxed at $2.83 per pound. In order to address concerns that some tobacco companies have simply begun labeling roll-your-own tobacco as pipe tobacco in order to avoid the tax, Representative Steve Cohen (D-TN) has introduced H.R. 4439, the Tobacco Tax Parity Act. This legislation would amend tax law to make the rate of tax for pipe tobacco the same as for roll-your-own cigarette tobacco.
This legislation has been referred to the Committee on Ways and Means in the House of Representatives. At the time of this writing, no similar legislation has been introduced in the United State Senate. Please be assured that I will keep your views in mind should this or similar legislation come before the Senate for consideration during the 111th Congress.

At 2.5 pounds for $65.45 that is 40 ounces divided by $65.45 or $1.64 an ounce times 7 ounces to a carton of 100 mm lights or $11.46 plus $4 for a carton of the Premier Lights tubes works out to about $15.46 a carton or 7.73 cents a cigarette for 100 mm lights. I do not know if there is a pipe tobacco tax from New York to Connecticut, but it would not be anymore than the cigarette tobacco tax of 20 cents an ounce which would add another $1.40 a carton or about $16.86 total a carton or 8.43 cents a cigarette for 100 mm lights.

In the State of Connecticut, there is a local state tax of 20 cents an ounce for imported lose cigarette tobacco that you have to pay or wait until the end of the year, when they bill you.
With 6 ounces of tobacco to make a carton, it works out to $19.08 for the tobacco for a carton of Gold Harvest plus $4.10 for a carton of cigarette tubes plus $1.20 Connecticut tax or $24.38 a carton of 187 cigarettes or 13 cents a cigarette.
